GENERAL TERMS AND CONDITIONS FOR POST-GRADUATE STUDIES OF THE INSTITUTO SUPERIOR DE DERECHO Y ECONOMÍA

PURPOSE
I. Applicability
This document is applicable to all candidates and students (hereinafter, the STUDENT(S)) of the postgraduate Master programs, Courses, Seminars (hereinafter, the PROGRAM(S)) taught at the Instituto Superior de Derecho y Economía (hereinafter ISDE)
Specific conditions may be established in the tuition contract of each particular PROGRAM.
ISDE´S ACADEMIC COMMITMENTS
II. Faculty
ISDE with its best judgment selects the most suitable teachers for the STUDENT and proper monitoring thereof; the most updated materials, and the best methodology that allows STUDENTS to attain the highest achievement in the PROGRAM that they have formalized their enrollment in.
III. Modification of contents
ISDE reserves itself the right to make any necessary changes in the structure and content of the PROGRAM, to offer the best training and the latest materials to the STUDENT.
IV. Certifying Title / Diploma
Once the corresponding PROGRAM has been completed and ISDE has verified that the STUDENT has done its work correctly, the STUDENT will receive the corresponding Diploma for each PROGRAM.
CONDITIONS FOR ENROLLMENT
V. Selection process for candidates
Candidates must complete the selection process established by ISDE for each PROGRAM. The lack of honesty in the information provided, as well as when conducting the pertinent admission tests, when necessary, will result in the immediate dismissal from the PROGRAM.
VI. Tuition and other amounts owed to ISDE
The payment of the tuition implies the commitment on the part of the STUDENT to occupy an irreplaceable place, said commitment is always in its entirety, even if it is conveniently divided into monthly payments. Therefore, if the STUDENT incurs in temporary or permanent withdrawal, it will not be exempted from full payment of the tuition.
Non-payment of tuition, in the terms and conditions set out in DIPLOMA OF ADMISSION, or any taxes, service fees or other amounts due to ISDE may result – prior decision of ISDE´s Academic Board and subject to the right of ISDE to claim the amounts due – in denial of access and continuity in the PROGRAM.
VII. Modification or cancellation of the call for applications by ISDE
ISDE reserves the right to cancel or delay the start of the call for each PROGRAM when the number of students enrolled does not guarantee the minimum quality of the same or when other circumstances occur that make it impossible to develop the PROGRAM correctly. This decision will be duly communicated to those affected STUDENTS.
In such case, the STUDENT may choose to:
(a) receive a refund of the amount paid for registration and reservation of place, or
(b) reserve a place for the next edition of the same PROGRAM, in which case the pertinent adjustments will be made to the registration and place reservation fees, and a fee for change of registration may be applied, or,
(c) reserve a place in another PROGRAM, in which case the appropriate adjustments will be made to the tuition and seat reservation fees, and a change of enrollment fee may apply.
STUDENTS who have received scholarships to attend the PROGRAM will be subject to the scholarship policy of the corresponding entity to determine if they can benefit from the scholarship in case of attending a subsequent edition of the PROGRAM or a new one.
VIII. Changes of calls by the STUDENT
The STUDENT may request two changes of course dates. Applications for convocations that are not consecutive to the Student’s original convocation will not be accepted.
The administrative management fees for a convocation change request by the STUDENT amount to €500 for the first request and €1,000 for the second request.
If the STUDENT does not attend the PROGRAM after two changes of the course, it will lose its place and will not be able to claim the amounts paid to ISDE as registration and place reservation.
IX. Withdrawal of enrollment by the student
- Withdrawal
All the rights recognized by Spanish legislation assist the STUDENT and, in particular, the General Law for the Defense of Consumers and Users or law that supersedes it.
The STUDENT therefore has 14 calendar days starting from the formalization of the registration to withdraw from the PROGRAM.
- Withdrawal before the start of the Program
The request must be expressly communicated in writing.
Under no circumstances will the amount paid by the STUDENT for Tuition be refundable, except as provided in the previous section (1. Withdrawal).
In case ISDE´s Academic Evaluation Commission considers the withdrawal request to be justified, the refund of the amounts paid by the student will be made in accordance with the following conditions:
- Refund of 80% of the amount corresponding to the Installment(s) paid, if the request is made more than seven (7) months in advance of the planned start date of the PROGRAM.
- Refund of 60% of the amount corresponding to the Installment(s) paid, if the request is made more than four (4) months in advance and less than seven (7), with respect to the planned start date of the PROGRAM.
- Refund of 40% of the amount corresponding to the Installment(s) paid, if the request is made more than two (2) months in advance and less than four (4), with respect to the planned start date of the PROGRAM.
- There will be no refund if the request is sent less than two months before the planned start date of the PROGRAM. In this case, ISDE reserves the right to claim the full amount of the PROGRAM. The Academic Evaluation Committee of ISDE may agree, once the request has been assessed, if it is necessary to cancel the student’s registration and, therefore, not claim pending amounts.
In all reimbursements and refunds, ISDE will retain the amount of €500 for administrative management expenses.
In order to calculate the deadlines and in the event that a particular day of the start of the PROGRAM is not indicated, ISDE will take into account that the start date is the 15th day of the month in which the beginning date of the PROGRAM is planned.
- Withdrawal more than two months in advance before the start of the program
In any case, and as an alternative to the previous point, the STUDENT may also choose, if the request is made more than two months before the planned start of the PROGRAM, any of the following two options

- Reserve a place for the next edition of the same PROGRAM, in which case the relevant adjustments will be made in the amounts per registration and reservation, a surcharge may apply for the change of edition, or
- Reserve a place in another PROGRAM, in which case the pertinent adjustments will be made in the amounts per registration and reservation, and a surcharge may apply for the change of edition.
- Once the Program has started
The request for withdrawal of the registration once the PROGRAM has started, will not entitle the STUDENT to any type of refund.
The Academic Evaluation Committee of ISDE may agree, once the request has been assessed, if it is necessary to cancel the student’s registration and, therefore, not claim the amounts that are pending.
In all reimbursements and refunds, ISDE will retain a minimum amount of €500 for administrative management expenses.
- In case the student has received a scholarship
STUDENTS who have received scholarships to study a certain PROGRAM will be subject to the scholarship granting policy of the corresponding entity to determine the consequences of the request for withdrawal of the registration and the possibility or not of refund of the amounts paid.
X. Program implementation/delivery
The location in which the PROGRAM is taught, as well as its start date may vary for academic (calendar changes and adaptations, needs of additional teaching resources, etc.), organizational or logistic matters (i.e. adaptation of facilities to the course)
Any definitive change in where the PROGRAM is imparted, will take place only within the cities of Madrid, Barcelona and Oviedo (Spain), and the start date, will be communicated to STUDENTS in advance.
STUDENT RESPONSABILITIES
XI. Grounds for refusal of access and continuity in the PROGRAM
ISDE reserves itself the right to deny access and continuity in the PROGRAM to participants who show a behavior that affects the normal functioning of classes, forums or engage in activities that violate their code of conduct, such as:
- The dissemination, without proper authorization, of materials provided at the completion of the courses or programs.
- The use of personal username and password to access the Virtual Campus by more than one person, causing ISDE a clear fraud.
- Carrying out activities that violate the intellectual property rights of ISDE, their teachers or peers.
- Lack of respect for people and ideas.
- Lack of respect for the teacher’s authority.
- Lack of respect to ISDE’s staff
- Misuse of classes, teaching materials and resources ISDE.
- Plagiarism or misconduct in performing academic tasks.
- Serious breach of Academic Regulations.
The Commission on Academic Assessment of ISDE is the body that assesses the facts and takes appropriate decisions after receiving the views of all parties implicated in the matter.
Disrespect to the Academic regulations and low performance within the PROGRAM may also be cause for denial of appropriate access and continuity. It is the Program Director´s duty to explain these circumstances, his or her recommendation and assessment of the PROGRAM´s Faculty, to ISDE´s Academic Council and the Commission of Scholastic Assessment.
The refusal of access to the PROGRAM or low performance in it, will imply the denial of the Certifying Title of the Degree.
XII. Respect of Academic Regulations.
The STUDENT is committed to develop within the PROGRAM to the maximum extent possible, reading the topics and readings, performing case studies, correctly performing the assessment tests that are proposed, taking an active participation in classes and performing, if applicable, one Final Master Case Study or other task to be established.
It will be the STUDENT’S responsibility to behave in accordance with ISDE’s General Regulations, as well as with the provisions of the PROGRAM’s Specific Regulations. Proof of non-compliance by the STUDENT with the aforementioned regulations will result in expulsion from ISDE, without the right to any refund or claim whatsoever.
XIII. Visa and residence permits
The STUDENT will be responsible for the handling documentation necessary to obtain the documents for its stay and legal residence in the location where the PROGRAM is conducted. The STUDENT will also be responsible for managing and obtaining housing.
Likewise, it will be the sole and exclusive responsibility of the STUDENT to obtain the necessary visas and administrative authorizations required by the countries of destination for the international academic stays which are foreseen, if applicable, in the academic program.
DATA PROTECTION AND IMAGE AND CONFIDENTIALITY
XIV. Data Protection and Image
All data and information provided before, during and after completing the activities of the PROGRAM will be processed by ISDE, in order to manage the academic relationship with the Institution, including the management of personal data and image of the STUDENTS, to be incorporated in documents and publications (graphic and/or audiovisual) of academic and/or promotional type of ISDE and to offer services, academic and promotional information (by electronic and non-electronic means) of ISDE. Likewise, ISDE may implement video surveillance systems in its facilities, for security purposes and for a better management of the training work.
The rights provided for in the privacy regulations in force may be exercised by sending your request to ISDE, at the address c/Serrano 208, 28002 Madrid or to its Data Protection Delegate at dpo@isde.es. Likewise, the STUDENT has the right to file a complaint before the competent Data Protection Authority.
The STUDENT authorizes ISDE to proceed to the use of its image in any support or format that ISDE deems convenient, free of charge, for the fulfillment of all or some of the purposes informed above.
XV. Confidentiality
The STUDENT assumes an indefinite duty of strict confidentiality and secrecy with respect to all Confidential Information to which the STUDENT has access due to his/her participation in the PROGRAM. For these purposes, Confidential Information includes all information, whether of ISDE or of any entity collaborating with ISDE, of an economic, financial, technical, commercial, strategic, administrative or any other type to which the STUDENT has access, especially that relating to reports, know-how, software, installations, methodologies, products, know-how, services, users of services, customers, commercial activities, as well as data and information of a personal nature, collected in any medium, and documentation of any other type that has been classified as proprietary or confidential or that, by its nature or by the circumstances in which the disclosure or creation occurs, must in good faith be considered as such.
In addition, STUDENT is required to comply with the following: (i) not to use for their own or others’ purposes, nor disclose to any third party, Confidential Information that has been entrusted to them and/or of which they have become aware on the occasion of their participation in the PROGRAM; (ii) not to use the name of any ISDE collaborating entity in social networks, nor produce profiles, blogs or websites on the Internet with such names; (iii) not to disclose having received the Confidential Information; (iv) during the five (5) years following the conclusion of the PROGRAM, regardless of whether or not they have obtained the degree, not to develop any business model that may be in direct or indirect competition with any business model to whose Confidential Information they have had access on the occasion of their participation in the PROGRAM; (v) destroy or return all the Confidential Information in their possession at the end of the PROGRAM.
Exceptions to the above are: (a) those cases in which ISDE and/or the collaborating entity have previously authorized in writing; (ii) that information that has been lawfully disclosed by the entity to which it belongs, (iii) that information which becomes public or that which must be disclosed in accordance with the laws, judicial resolution and/or imperative act of a competent authority.
The disclosure of Confidential Information does not constitute, in any case, a transfer or license, explicit or implicit, in favor of the STUDENT on any rights of which the entity to which it belongs, is the holder.
In case of breach of the above confidentiality commitment, the STUDENT will be immediately dismissed from the PROGRAM, with loss of all the benefits inherent in being a STUDENT and/or former STUDENT of ISDE and must pay the amount of the tuition pending payment at the time of dismissal, if not already paid, and without prejudice to any compensation and/or legal actions that ISDE and/or the collaborating entity may exercise in defense of any rights they have recognized, all of which are expressly reserved.
SCHOLARSHIPS AND PROMOTIONS
XVI. Conditions for receiving scholarships
Scholarships will be awarded on the basis of merit and/or economic need under the conditions determined by the entity granting the corresponding scholarship.
The different scholarships and promotions to access the PROGRAMS granted by ISDE or other entities are not cumulative among themselves, unless expressly provided for in the terms and conditions of the scholarship or promotion.
MISCELLANEOUS
XVII. Use and Rights of Students’ Work
ISDE may make use of the work, projects or any type of contribution made by the STUDENT during the PROGRAM without the express written consent of the STUDENT.
The STUDENT exclusively grants ISDE, free of charge, the rights (including, but not limited to, intellectual and/or industrial property rights) that may derive from the materials and/or contents developed in whole or in part, directly or indirectly, as a result of the PROGRAM, without any spatial and/or temporal limitation in accordance with the provisions of the current legislation.
XVIII. Force Majeure and Fortuitous Event
In the event that the normal development and provision of the educational services may be affected by any event beyond ISDE’s reasonable control, ISDE reserves the right to activate the contingency protocols it deems necessary and to adopt, among other measures, the provision of the services in e-learning format in a synchronous manner or, if necessary, to postpone their provision until the event in question is over.
XIX. Employment Relationship
The Student hereby understands that ISDE does not guarantee job placement to STUDENTS upon completion of the program.
