2. PURPOSE AND SCOPE OF APPLICATION

2.1 These are the general conditions (hereinafter, the “general conditions”) governing access to, browsing and use of the websites under the domain names “isdemasters.com”, “isdegrado.com” and others linked to ISDE (hereinafter, the Website), as well as the responsibilities arising from the use of their contents (hereinafter, “contents” meaning texts, graphics, drawings, designs, code, software, photographs, music, videos, sounds, databases, images, expressions and information, as well as any other creation protected by national laws and international treaties on intellectual and industrial property). Notwithstanding the foregoing, ISDE may establish specific conditions governing the use and/or contracting of specific services offered to Users through the Website.

2.2 Access to or mere use of the Website by the User implies acceptance of the general conditions published by ISDE at any given time. Therefore, the User must carefully read these general conditions.

For these purposes, “User” shall mean any person who accesses, browses, uses or participates in the services and activities, whether free of charge or paid, offered on the Website.

2.3 Through the Website, ISDE may allow third parties to advertise or provide their services. In such cases, ISDE shall not be responsible for establishing the general or specific conditions applicable to the use, provision or contracting of such third-party services, nor shall it be liable for them.

2.4 Before using and/or contracting any specific services provided by ISDE, the User must carefully read the corresponding specific conditions. The use and/or contracting of such services implies acceptance of the specific conditions in force at the time.

2.5 In compliance with Article 4.4 of Decree 84/2004, ISDE shall duly inform users of those programmes that do not lead to the award of an officially recognised degree.

3. INTELLECTUAL AND INDUSTRIAL PROPERTY RIGHTS

3.1 ISDE, as the author of a collective work or of any work or performance of any nature, is the owner of the intellectual and industrial property rights of the Website and also holds ownership or the corresponding licence for the intellectual, industrial and image rights over the contents available through it.

3.2 Under no circumstances shall access to or browsing of the Website be understood as a waiver, transfer, licence or assignment, in whole or in part, of such rights by ISDE.

3.3 Consequently, it is not permitted to remove, bypass or manipulate copyright notices or any other identification data of ISDE’s rights or those of its licensors, nor any technical protection devices, digital fingerprints or information and/or identification mechanisms contained in the contents.

3.4 It is also prohibited to modify, copy, reuse, exploit, reproduce, publicly communicate, republish, upload files, send by mail, transmit, use, process or distribute, in any way, all or part of the contents included on the Website without the express written authorisation of ISDE or the relevant rights holder.

In particular, ISDE expressly opposes the reproduction of its pages being considered a quotation under Article 32.1, second paragraph, of the Spanish Intellectual Property Law.

4. ACCESS

4.1 Access to the Website is free of charge. However, some services and contents offered by ISDE or third parties may require prior contracting and payment, as set out in the applicable Specific Conditions.

4.2 Where registration or the provision of personal data is required to access certain services, the collection and processing of such data shall be governed by the Privacy Policy published on the Website.

4.3 The contracting of products and services through the Website by minors is prohibited. Prior consent from parents, guardians or legal representatives is required, who shall be responsible for the actions of minors in their care.

5. USE OF THE WEBSITE

5.1 The contents of the Website are provided exclusively for end users. Any unauthorised commercial use or resale is prohibited without ISDE’s prior written consent.

5.2 If registration is required, the User is responsible for providing accurate and lawful information. If a password is assigned, the User undertakes to use it diligently and keep it confidential. Users are responsible for safeguarding their credentials and must not share them with third parties.

5.3 The User must immediately notify ISDE of any unauthorised use of credentials. Until such notification is made, ISDE shall not be liable for any improper use by third parties.

5.4 Access to and use of the Website is the User’s responsibility. The User undertakes to comply with all instructions issued by ISDE and to report any unlawful conduct or infringement of third-party rights.

5.5 The User undertakes, in particular, to refrain from:

1. using the contents for unlawful purposes or in breach of public order or accepted moral standards;
2. reproducing, copying, distributing, publicly communicating, transforming or modifying the contents without authorisation;
3. using the contents or information obtained to send advertising, commercial communications or unsolicited messages, or to commercialise such information.

6. PERSONAL DATA

The User authorises ISDE to process their data for the provision of educational services and related activities, including job placement and information on academic subjects and related economic sectors. The User authorises the transfer of their data to other companies within the Difusión Jurídica Group for these purposes.

• If the programme is the Digital Master Business Administration, data will be shared with ISDI – Digitalent Group S.L.
• If the programme is the Master’s in Sports Management and Legal Skills, data will be shared with Futbol Club Barcelona.
• If the programme is the Global Master in Sports Management and Legal Skills, data will be shared with Futbol Club Barcelona.
• If the programme is the Executive Master in Sports Law and Management, data will be shared with Club Estudiantes, S.A.D.
• If the programme is the Master’s in Industrial Property, Intellectual Property, Competition and New Technologies, data will be shared with Pons Escuela de Negocios S.L.
• If the programme is the Master’s in Representation and Management of Artists and Athletes, data will be shared with Pons Escuela de Negocios S.L.
• If the programme is the Course for Access to the Legal Profession, data will be shared with the Illustrious Bar Association of Terrassa.

The User authorises ISDE and the companies of the Difusión Group to send electronic communications related to the above purposes.

Student data will form part of ISDE’s files. Rights of access, rectification and cancellation may be exercised by writing to Calle Serrano, 208, 28002 Madrid, or by email to info@isde.es.

7. LIABILITIES AND GUARANTEES

7.1 ISDE does not guarantee the legality, reliability, usefulness, accuracy or completeness of the services or information provided through the Website.

7.2 ISDE shall not be liable for interruptions, errors, viruses, security breaches, lack of usefulness or damages caused by misuse of the Website.

ISDE declares that it has adopted all reasonable measures to ensure proper functioning of the Website and prevent harmful components.

8. DURATION AND MODIFICATION

8.1 ISDE may modify these terms at any time by publishing the changes.

8.2 These conditions shall remain in force until modified.

8.3 ISDE may suspend or terminate access to the Website at any time without notice, without entitling the User to compensation.

9. GENERAL PROVISIONS

9.1 Clause headings are for information only and do not affect interpretation.

9.2 In the event of conflict, specific conditions shall prevail over general conditions.

9.3 If any provision is declared invalid, the remaining provisions shall remain in force.

9.4 Failure by ISDE to exercise any right shall not constitute a waiver thereof.

10. JURISDICTION

10.1 The relationship between ISDE and the User shall be governed by applicable law. Where permitted, both parties submit expressly to the Courts and Tribunals of the city of Madrid, waiving any other jurisdiction.
