GENERAL TERMS AND CONDITIONS OF CONTRACTING FOR ISDE PROGRAMS

PURPOSE

I. Applicability

This document applies to all candidates and students (hereinafter, THE STUDENT) of the Degree programs in their different modalities (hereinafter, THE PROGRAMS) of the Higher Institute of Law and Economics (hereinafter, ISDE).

Specific conditions may be established in the Student’s Admission Diploma to ISDE, with this document applying on a supplementary basis to those conditions.

It is important to note the distinction between the reservation of a place, which THE STUDENT makes after admission and once the tests have been passed, and the enrollment carried out at the Complutense University of Madrid or Northumbria University, as applicable (hereinafter, the University).

ISDE ACADEMIC COMMITMENTS

II. Faculty

ISDE, using its best judgment, provides THE STUDENT with the most qualified faculty for proper academic guidance; the most up-to-date materials; and the most suitable online methodology to enable THE STUDENT to make the most of the Program in which they enroll.

III. Modification of contents

ISDE reserves the right to make any modifications it deems appropriate to the structure and contents of THE PROGRAMS in order to provide the best education and the most up-to-date materials to students. ISDE also reserves the right to modify faculty members, collaborators, or academic partner institutions, both for specialization programs and for international academic stays.

IV. Certification

Once the corresponding PROGRAM has concluded and ISDE has verified that THE STUDENT has completed their work properly and satisfactorily, THE STUDENT will receive the qualification corresponding to the PROGRAM completed.

V. Modification or cancellation of the intake

ISDE reserves the right to cancel or delay the start of the program intake when the number of enrolled students does not guarantee its minimum quality or when another circumstance prevents the proper development of the program. This decision will be duly communicated to those affected.

In the case described above, THE STUDENT may choose to:

i. receive a refund of the proportional amount paid.

ii. reserve their place for the next edition of the same program, in which case the relevant adjustments will be made to the tuition and reservation fees, and a change-of-enrollment fee may apply; or

iii. reserve a place in another program, in which case the relevant adjustments will be made to the tuition and reservation fees, and a change-of-enrollment fee may apply.

STUDENTS who have received scholarships to take the program will be subject to the scholarship policy of the corresponding entity to determine whether they may benefit from the scholarship in the event of attending a later edition of the program or a new one.

GENERAL CONDITIONS FOR PLACE RESERVATION AND SUBSEQUENT ENROLLMENT AND TEACHING

VI. Candidate selection process

Candidates must complete the selection processes established by ISDE to pursue the Degree. Lack of honesty in the information provided, as well as in the completion of any tests carried out, will result in immediate expulsion from the PROGRAM.

VII. Payment of reservation, enrollment and teaching

a. Reservation

Payment of the place reservation secures the student’s place in the program and academic year to which they have been admitted. This amount will only be refunded if THE STUDENT does not meet the legal requirements for university admission.

b. Enrollment

Once the university admission requirements have been met (EVAU, high school diploma recognition, credentials, and/or similar), enrollment will be formalized at the University. For newly admitted students, this payment is assumed by ISDE for the first year. Payment of the Enrollment Fee for the second year and subsequent years will be the responsibility of THE STUDENT.

The total amount to be paid by THE STUDENT to ISDE for each academic year will be the one identified in their Admission Diploma. If THE STUDENT enrolls in failed subjects and/or additional subjects beyond those provided for in the study plan for each academic year, an annual surcharge will apply: €1,000 for each additional subject of the Law Degree and €600 for each subject of the corresponding Specialization Program.

c. Teaching

THE STUDENT undertakes the commitment to occupy a non-replaceable place and pay for the teaching services. This commitment always covers the full amount, even if payment is divided into monthly installments for convenience. Therefore, if THE STUDENT temporarily withdraws, they will not be exempt from payment of the total amount, and ISDE reserves the right to claim the full annual amount committed.

Failure to pay the reservation or teaching fees under the terms and conditions set out in the ADMISSION DIPLOMA, or any enrollment fees, administrative costs, or other amounts owed to ISDE, may result in denial of access to and continuation in the Degree if so decided by ISDE’s Academic Evaluation Committee, without prejudice to ISDE’s right to claim the amounts owed.

VIII. Withdrawal or cancellation of enrollment by THE STUDENT

i. Right of withdrawal

THE STUDENT enjoys all rights recognized under Spanish legislation and, in particular, the General Law for the Protection of Consumers and Users or any law that replaces it.

Therefore, THE STUDENT has 14 calendar days from the formalization of the place reservation to withdraw from it.

ii. Cancellation before the start of the Program

The request must be made expressly and in writing.

The amount corresponding to the place reservation will not be refunded except as provided in Section VI: a. Reservation.

iii. Once the Program has started

The request for cancellation must be made expressly and in writing. Once the PROGRAM has started, it will not give the right to any refund of the amounts paid for place reservation, enrollment, or teaching.

iv. Request for change of intake

THE STUDENT may request up to two changes of intake. Requests for intakes that are not consecutive with respect to the student’s original intake will not be accepted.

Administrative management fees for the intake change request amount to €500 for the first request and €1,000 for the second.

IX. Program delivery

The location where the programs are delivered, as well as their start date, may vary for academic reasons (calendar changes and adjustments, additional teaching resource needs, etc.) and organizational or logistical reasons (adaptation of spaces to the set of courses delivered).

X. International Academic Stays

The international academic stays included in the Degree programs will last one intensive academic week. However, ISDE, in accordance with the academic plan of the host university/institution, may unilaterally extend their duration in order to offer students better educational benefits.

STUDENT RESPONSIBILITIES

XI. Grounds for denial of access and continuation in the PROGRAM

ISDE reserves the right to deny access to and continuation in the PROGRAM to participants who display behavior that affects the normal functioning of classes or forums, or who carry out activities that violate its code of conduct, such as:

a) Disseminating, without proper authorization, materials provided during the courses or programs.

b) Use of a personal and non-transferable username and password by more than one person, causing clear fraud to ISDE.

c) Carrying out activities that violate the intellectual property rights of ISDE, its professors, or fellow students.

d) Lack of respect for people and ideas.

e) Lack of respect for the authority of the professor.

f) Inappropriate use of ISDE classes and material or educational resources.

g) Plagiarism or lack of ethics in the completion of academic assignments.

h) Failure to comply with Academic Regulations.

ISDE’s Academic Evaluation Committee will assess the facts and make the corresponding decision after receiving the opinions of all parties involved. Denial of access to the PROGRAM or removal from it will imply denial of the corresponding certification.

XII. Compliance with general and specific academic regulations

THE STUDENT undertakes to carry out the PROGRAM with the maximum level of commitment by reading the topics and complementary materials, completing practical cases, properly undertaking the evaluation tests that may be proposed, and actively participating in classes.

It will be the student’s responsibility to maintain behavior in accordance with the preceding section “Grounds for denial of access and continuation in the PROGRAM,” ISDE’s General Academic Regulations, and the Specific Academic Regulations, where applicable.

XIII. Visas and residence permits

THE STUDENT will be responsible for processing the documentation required to obtain the documentation necessary for their stay and legal residence in Spain. They will also be responsible for managing and obtaining their accommodation.

Likewise, it will be the sole and exclusive responsibility of THE STUDENT to obtain the visas and administrative authorizations required for the destination countries of the international academic stays included in the academic program.

DATA AND IMAGE PROTECTION

XIV. Data and Image Protection of STUDENTS and Confidentiality

All data and information provided before, during, and after the completion of the activities of the Training Program will be processed by ISDE in order to manage the academic relationship with the Institution, including the management of personal data and image of Students to be incorporated into documents and publications (graphic and/or audiovisual) of an academic and/or promotional nature of ISDE and to provide services and academic and promotional information (by electronic and non-electronic means) from ISDE. ISDE may also implement video surveillance systems on its premises for security purposes and to improve the management of educational activities.

The rights provided for under current privacy regulations may be exercised by sending a request to ISDE at c/Serrano 208, 28002 Madrid or to its Data Protection Officer at [dpo@old.isde.es](mailto:dpo@old.isde.es). The Student also has the right to file a complaint with the competent Data Protection Authority.

The Student authorizes the recording of their image in any medium or format that ISDE deems appropriate, free of charge, for the fulfillment of all or some of the purposes previously indicated.

XV. Confidentiality

The Student assumes an indefinite duty of strict confidentiality and secrecy with respect to all Confidential Information to which the Student has access as a result of participation in the Program. For these purposes, Confidential Information includes any information, whether belonging to ISDE or any collaborating entity of ISDE, of an economic, financial, technical, commercial, strategic, administrative, or any other nature to which the Student has access, especially information relating to reports, technical knowledge, software, facilities, methodologies, products, know-how, services, service users, clients, commercial activities, as well as personal data and information recorded on any medium, and documentation of any other type that has been classified as exclusive property or confidential or which, by its nature or the circumstances in which it is disclosed or created, should in good faith be considered as such.

Additionally, the Student agrees to comply with the following: (i) not to use for personal or third-party purposes, nor disclose to any third party, Confidential Information that has been entrusted to them and/or of which they have become aware as a result of their participation in the Program; (ii) not to use the name of any collaborating entity of ISDE on social networks, nor create profiles, blogs, or websites on the Internet using those names; (iii) not to disclose having received Confidential Information; (iv) for five (5) years following the conclusion of the Program, regardless of whether the qualification has been obtained, not to develop any business model that may directly or indirectly compete with any business model whose Confidential Information was accessed during participation in the Program; (v) to destroy or return all Confidential Information in their possession upon completion of the Program.

The above will not apply in the following cases: (a) when ISDE and/or the collaborating entity has previously authorized it in writing; (ii) when the information has been lawfully disclosed by the entity to which it belongs, becomes public, or must be disclosed in accordance with law, a judicial decision, or a mandatory act of a competent authority.

The disclosure of Confidential Information shall in no case constitute a transfer or license, explicit or implicit, in favor of the Student regarding any rights held by the entity to which it belongs.

In the event of breach of the above confidentiality commitment, the Student will be immediately expelled from the Training Program, losing all benefits inherent to being a STUDENT and/or former STUDENT of ISDE and being required to pay any outstanding tuition amount at the time of expulsion, if not already paid, without prejudice to any compensation and/or legal actions that ISDE and/or the collaborating entity may take in defense of any rights recognized to them, all of which are expressly reserved.

SCHOLARSHIPS AND PROMOTIONS

XVI. Conditions for receiving scholarships

Scholarships may be granted based on merit and/or financial need under the conditions determined by the entity granting the scholarship.

The different scholarships and promotions for accessing the PROGRAMS granted by ISDE or other entities are not cumulative unless expressly stated in the terms and conditions of the scholarship or promotion.

The conditions of the scholarships and/or promotions awarded to their beneficiaries are individual and strictly confidential, and THE STUDENT must maintain absolute secrecy regarding them. If a third party not concerned becomes aware of them, it will always be presumed that the leak of information comes from THE STUDENT, and ISDE reserves the right to unilaterally cancel the conditions of the scholarship and/or promotion awarded.

MISCELLANEOUS

XVII. Use and Rights of work carried out by Students

ISDE may use the work, projects, or any type of contribution made by THE STUDENT during the PROGRAM without requiring their express written consent.

The Student assigns exclusively to ISDE, free of charge, the rights (including, among others, intellectual and/or industrial property rights) that may arise from materials and/or content developed totally or partially, directly or indirectly, in connection with the Program, without any spatial and/or temporal limitation, in accordance with current legislation.

XVIII. Force majeure and unforeseen circumstances

If the normal development and provision of teaching services are affected by any event beyond ISDE’s reasonable control, ISDE reserves the right to activate any contingency protocols it deems necessary and adopt, among other measures, the provision of services in synchronous e-learning format or, where appropriate, postpone their delivery until the event in question ends.

XIX. Employment relationship

THE STUDENT understands that ISDE does not guarantee job placement for students upon completion of the Program.
